The Ecad is administered by seven music collective administration societies and represents all the title holders of musical works affiliated to it (composers, performers, musicians, music publishing companies and recording companies). When a right-owner becomes a member of an association, the entity becomes the proxy [of the right-owner] as regards all the necessary activities to defend his copyrights, including the right to collect copyrights. As for this purpose the Ecad is actually organized by these associations, the Office is responsible for the collection and distribution of the moneys throughout Brazil. In this capacity, the Ecad represents thousands of artists members of the nine associations.
The General Assembly of the Ecad, which is composed by these associations representing the interests of their members/right-owners, is responsible for determining the royalties to be paid and the collection and distribution rules, which are based on international criteria.
The musical right-owner must become a member of one of the seven associations and inform the repertoire, which comprises all the musical works, as well as the percentage of participation corresponding to each author in the creation of the work, as this value will serve as a guide for the distribution of the rights of public performance of the respective musical works. The artist should always update the information on the musical repertoire registered at the entity or association.
The associations in turn are responsible to control and deliver to the Ecad the registry information of each member and of their musical repertoire, in order to feed the database and facilitate distribution of money collected from music users. The right-owner is then credited the amounts that correspond to the musical works captured and identified by the Ecad, and which are performed by users, i.e. the payers of copyrights. These amounts are transferred by the Ecad to each association.
